Section 498A in The Indian Penal Code, 1860
498A. Husband or relative of husband of a woman subjecting her to cruelty.-- Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine.
1. Chapter XXA inserted by Act 46 of 1983, s. 2.
Explanation.- For the purposes of this section," cruelty" means-
(a) any wilful conduct which is of such a nature as is likely to drive the woman to commit suicide or to cause grave injury or danger to life, limb or health (whether mental or physical) of the woman; or
(b) harassment of the woman where such harassment is with a view to coercing her or any person related to her to meet any unlawful demand for any property or valuable security or is on account of failure by her or any person related to her to meet such demand.] CHAPTER XXI OF DEFAMATION CHAPTER XXI OF DEFAMATION
 
             Questions :
 
                               (i) Did she ever lived with you , leaving her mother
 
                            (ii) What about the two sisters , are they not taking care of their mother
 
                             (iii) What kind of cruelity is mentioned , or harrassment in the Case
 
                            (iv) After how much gap this case was filed
 
                            (v) And whether it was filed while living with you which culminated to leave you or after she left you and while you refused to shift to her mothers house.,
 
                            More questions can be asked , and I urge other experts to ask thjem here .

             Questions :

 

                               (i) Did she ever lived with you , leaving her mother

Yes, but she always thinks about her mother.

 

                            (ii) What about the two sisters , are they not taking care of their mother

Other sister do not care of her mother. Not Even her husband and in-laws.

 

                             (iii) What kind of cruelity is mentioned , or harrassment in the Case

Dowry demand since marriage but after marriage only festivals customs were done.

 

Husband and relatives "maarte peet te hai dhake maar ke ghar sai nikal diya"  but there is no injury no MLR.

 

                            (iv) After how much gap this case was filed

After 8 months gap and there is no reason given why she was late by 8 months.

 

                            (v) And whether it was filed while living with you which culminated to leave you or after she left you and while you refused to shift to her mothers house.,

After she let and While I refused to shift to her mother's house.

 

                            More questions can be asked , and I urge other experts to ask thjem here .
