Non deposit of epf & basis pay reduced

Dear Sir,

pl. any one clarify & guide me. now i have face the below problem in my current working private company.

1. my EPF share of Rs. 780/- is our company has deducted every month from salary & they have to pay equal amount of Rs. 780/- as employer share to employee EPF A/c.  but last one year, they are not deposited in my EPF a/c and not given any proof for deposits to me.  our company not deposit the epf not only me over all company.

2. from my joining year of 2008 onwards my basic salary is 60% in gross salary. mean time the year of 2013 the company has reduce the basic salary from 60% to 30% in gross salary. diff. 30% they are shown is a special allowance in salary slip.

since i am completed 5 year & eligible for gratuty. gratuty is calculated for last basic + DA only.  here there is no DA.

now  i am lost my 50% of gratuty amount.

kindly guide me the above problems.

PF: Non submission of PF dues is offence. You may demand from good offices of the company: appointing authority, MD with a copy to HR head, the PF a/c slips/passbook of each year by redg. Post. If the good offices or HR does not respond then employees may lodge a complaint thru RPFC in nearest PF office.

if company is listed in defaulters and 7A proceedings have been initiated or not?

All employees may request the RPFC to allow them to be intervener in this case.

Salary: Did you and other employees accept restructuring of wages in writing? PF officials don’t accept reduction in PF contribution. They may demand PF contribution on special allowance also. The concerned authority is APFC/RPFC/Addl. CPFC of state/CPFC.

Gratuity: If DA was part of wages earlier then company may not succeed to remove it now.

In private sector DA is not given by majority of the employers.

Employees for best protection of their rights must form Employees’ unions/IC/Guild/Works Committees and affiliate with Trade Unions and keep access to a god labor Consultant/Service lawyer. .
