Not being paid by ex-employer

I joined a small software firm. I didn't like the place very much, so I tried getting a new job and did get one soon. In exactly a month from the joining, I tended my resignation and proposed willingly to serve the month-long notice period mentioned in the offer letter. They paid me the first month's pay only partially, didn't pay the PF or the IT IDS either, citing it'll take more time to do it. Anyway I completed the notice period with all sincerity. \

After several failed attempts at getting them to respond and visiting their office, I finally got them to issue me relieving letter and proper experience letter. Then I moved to another city for the new job. But it's been two weeks, and they haven't yet issued me any FNF, form-16 or paid me at all for the second month(i.e. the notice period), nor any of the dues from the first month. They haven't paid me any of the relocation reimbursement money either. I've been trying to contact them, writing a mail a day, but they don't respond at all.

What course of action should I take?

In a given situation employee can invoke the provisions of Industrial Employment Standing Orders Act, ID Act, SE Act, Payment of Wages Act…..etc  as per explanation of employee under these enactments or approach a civil court.

The state of Karnataka has ended the blanket exemption granted to IT/ITES industry.

If emails are not fetching you any relief you may approach either the authorities under various enactments on your own or thru your lawyer. Your lawyer may confirm that you fall within the category of a workman.

Company may relent upon legal notice of your lawyer or you may have to agitate.

Majority of the employer feel that employee shall give up after sending a few emails.

Employer do relent in case of firm and properly informed employees.
