Owner not returning the deposit

Hi,

I was staying with my cousin in a rented house from Apr 17 to Jun 17. The rent was 9k+EB and the Deposit was 40k. On the agreement, it was written that either side had to give a notice of 3 months for vacating the house. We stayed there for three months. We gave the notice at the end of the 2nd month to the owner's wife as he was not at home for a long time and left the house at the end of third month. Now he is not returning the deposit money. He says that he will return once he gets a new tenant. The owner is a political leader of that area. He neither speaks Hindi nor English. He speaks only Tamil which we don't speak. Please let me know if there is any way to get the money back.

Technically, if your agreement stated that the notice for vacating the house would have to be given 3 months prior, you aren't entitled to get your security back before August/September (since you informed to vacate by May end.) In my opinion, you wouldn't have any cause of action till then.
