  1. After the Court’s Partition Decree
Once the court has granted the partition decree, the property is divided according to the court’s decision. Now, to ensure that the new ownership reflects properly in official records, you need to apply for Pahani (for rural land) or Katha (for urban land).
  2. What are Pahani and Katha?

    • Pahani is a crucial record in rural areas, maintained by the Revenue Department. It lists all the details about the land — such as ownership, land area, cultivation, etc.
    • Katha is similar but used for urban properties, mostly for property tax purposes, where the municipality keeps track of ownership.
  3. When Should You Apply for These Records?
There isn’t a strict legal deadline for applying for Pahani or Katha after a partition decree. However, it's always a good idea to update the records as soon as possible. Generally, it’s best to apply within a few months (around 3 to 6 months), but this can vary by location and local laws.

  4. What Happens If You Don’t Apply?

    • Transaction Problems: If you don’t apply for the updated records, it could create problems later on when you want to sell, transfer, or mortgage the property. Without the updated records, it becomes much harder to prove ownership, and potential buyers or banks may hesitate to deal with you.
    • Tax Issues: The land or property taxes might still be linked to the previous ownership records, which can lead to confusion and even higher tax liabilities.
    • Legal Difficulties: If the records aren’t updated, it may cause delays when you need to assert your rights over the property. You might face challenges in dealing with authorities, especially if the records are still showing joint ownership or past ownership details.
  5. How to Apply for Pahani and Katha?

    • For Pahani: Visit the local Tehsildar office or Revenue Department with a copy of the court’s partition decree and your identity documents. The staff will guide you through the process of updating the land records to reflect the new ownership.
    • For Katha: For urban properties, go to the Municipal Corporation or Property Registration Office. You will need the court’s decree, proof of ownership, and identification documents to get the Katha updated in your name.
  6. Why It’s Important to Act Quickly
While it may seem like a task you can put off, updating these records sooner rather than later will save you a lot of stress and hassle in the future. It will ensure that your name is on the official records, making future transactions much easier and helping you avoid potential legal or tax issues. Plus, it’s one less thing to worry about down the road...
