Parking charges in housing society

Dear Sir

In our housing society a member was allocated stilt car parking. 

From October 2014 the concerned member has no vehicle. 

So the society has not added parking maintenance charges in to his quarterly bill for Oct - Dec 2014.

The member argues that even though he does not have car parking maintenance charges should be included in to his bills as the society has allocated the parking place to him. His intention is to retain the empty parking slot with him.

But the Secretary says that as he does not have car automatically the place will be allocated to some other needy member.  The Secretary also assured that if the concerned member will have a car in future he is ready to provide a parking for him. 

Please advice to resolve this issue.

Sir,

As per section 79 of the CHS Bye-Laws, only a member having a vehicle can be allotted a parking space, since the member in your query does not have a vehicle he can not legally demand allotment of a parking space.

The relevant sections on parking are as per the attached sheet.

It is a matter to be decided in the AGM of the society.  The secretary has no rights to say that the member is forfeited to use the car parking space if he has no car to park, it is illegal, the matter has to be decided by a resolution in the society meeting.
