Partition common land of well

My father grand father having four sons and two wifes, but my grand father is only son of first wife and rest three sons other wife. my grand father having 4 acres land and they divided the land in equal with common well (10 cents) . but now all divided land respective sons. currenty our common well doesn't have water , so that we are all take decision to close the well and divide into 4. The common Well land patta (Govt Legal Document) name only 3 persons name. is there eligible to divide into 4? other person is eligible to claim the land?

Kindly advise us.

you dicuss with PWD department as water is their domain and no longer is a pivate property and follow their advice..If you appreciate this answer please give me all my profile likes.

Dear Ms.usha Kapoor

Thanks for your reply, but i really did not mentioned your clear. becuase this land and well only for 4 persons of my father of grand father sons not to public and others.

only 4 persons can claim the rights. 3 out 4 have rights in govt legal document. is there possible claim other person (4th person)?

That time, your grandfather's time water was private property. But now wherever drinking water is there be they are taps, wells, bhorwells etc that has become every body's./ It has ADOPTED SOCIALISM.In view of water scarcity Government has nationalized water.
