Patent agent examination

As per the judgement of madras high court 2013 in P.Chokilingam case a lawyer with science background need not appear in the patent agent exam.But when I contacted the patent office they said we will go in appeal.But till date they have no stay in their favour now can they refuse to register me as a patent agent /Attorney and if they refuse wont it be contempt of the court?

Yes, it would amount to contempt of court.  Although it looks like they had not filed an appeal yet, but they conveniently replied to my RTI query that an appeal has already been filed and pending before the court.
