Payment of dues in absence of letter of administration

My wife has passed away intestate, leaving behind a flat which was under construction when she passed away. The flat is ready for possession, but possession is not taken because I and my minor son have applied for Letter of Administration around 7/8 months back. The builder is asking me to pay the dues for society formation charges/development charges/service tax/VAT/maintenance/etc. I requested the builder to wait for a few more weeks for the Letter of Administration to come for the final settlement of all charges. But he insisted me to clear the dues now only (in absence of the certificate).

 

My query here - whether it is advisable to make the payment of all dues on my late wife's flat while the application for Letter of Administration is pending in the hon'ble high court?

Your wife died intestate you do not need letter of administration. You can legal heir certificate . You pay dues to Builder in your name take receipt or issue your cheque.
