I don't know where my earlier query got posted or not so resending the query again. Please forgive me for the same.
MY QUERY
I am not sure if I am posting my query under the appropriate law head. If not, kindly forgive me. My query is as follows.
I own a flat in a registered society located in Nerul. Owing to my office tours and other commitments, it is not possible for me to attend the various meeting being conducted by the society. I have rented the flat and every month pay the society monthly dues including the non-occupancy charges on time.
Few years back, in the name of repairing work, the society had collected Rs 10,000/- from each member but such repairs on the massive scale were never carried out.
Recently society has started convening meetings again in the name of repairing etc. The meetings are held any arbitrarily at short notice and it is not possible for me to attend the meetings which many times result only in quarrels and arguments among the members attending the meeting.
Last month the society has charged me Rs 250/- penalty for not attending the meeting. When questioned about this penalty, the secretary arrogantly replied that we will charge such penalties and if we conduct 10 meetings in a month, each time we will charge you penalty. This month society has charged me Rs. 500/- penalty besides my monthly dues.
My query is if I am paying all my monthly dues regularly and also in principle ready to pay for charges towards the repairing etc as and when required, is it legal on part of the society to charge me penalty for not attending their meetings.
Does the law provide such a right to charge me penalty for not attending the meeting? If not, what course of action I can take against the society?
