Dear Sir,
Plaintiff filed an ejectment suit under transfer of property act 106 against a partnership firm on 2009 January, and also legal notice sent to all 8 defendants. 4 defendants contested in this case , and rest of the 4 defendants were ex party. Case was held for 3.5 years and the suit was allowed in favor of plaintiff. I want to know “Can I reopen and recall this case by calling ex party defendants through the miscellaneous petition?”
NOTE : Proper notice and proper summon were not issued to this 4 ex party defendants .
