possession of flat

actually in our property there where 3 name and from this only 1 person has transfered his name to other person in his family only with gift deed.....but the problem is that we have not taken possession of the flat and we have some amount left to pay the builder, which we are ready to pay....my doubt is, if we told the builder that we done gift deed, will he take any objection or any transfer fee without taking his noc...please help

Builder will get E.C. from sub-registrar office and get to know who is gift giver and receiver. Accordingly he will follow further.

thankyou for your response.....actually the society is formed still not taken possession of the flat only small amount is remaining to pay the builder.....we are 3 family memeber only in this flat from which onfamily member has done gift deed for another family member...so its better to say the builder that we have done gift before possession or after possession...

Hello,

Yes, you have to disclose the transfer of one share to other person. You can pay the proportionate amount of transfer NOC charges to builder. His object will upto NOC charges only and he has no other concern. Builder charges nominal amount of transfer charges.

thanks for response sir.....can I disclose the gift deed after paying all the dues of the builder, and while taking possession...to avoid transfer charges
