Public interest litigation (pil)

One real estate company collected amounts in pre-launch of a apartment project. After 3y of times investors are realised that they are cheated by builder.  Out of 150 members investors group, 10 members filed cases u/s 138 of NI Act so far in different courts.

The builder is launched 9 projects, all are out of rule and pre-launch projects. He is not caring any legal actions taking by individual persons. Still the builder is continuing to collecting money from public. 

Would it be eligible to file a PIL in HC. ?

Purpose and relief in PIL shall not serve required purpose and proper relief(s) to the customer(s).  

Instead of filing PIL a complaint before RERA and / or Consumer Complaint in jurisdictional Fora may be preferred through a local prudent lawyer.

R.E.R.A. is answer to all buyers and sellers of the immovable properties. The lack of regulation made investing in real estate unpopular among people. The real estate industry needed a regulator who can frame rules, regulate transactions, and bring in more transparency to the sector.

Even a criminal action for cheating could be initiated.
