Quash after 4 years, they filed chargesheet

sir,

I am victim of 498A as A5 in that case. The investigation officers (01 to 04) filed chargesheet after 4 years 3 months. The lower court issue the order to the investigation officer for filing of police report in said case docket order at Jun 2014 but did not filed chargesheet until March 2016. The A6 & A7 was arrested on 2013 then got a bail. Eminently, A6 & A7 filed quash petition in High court finally allowed petition in July 2015.

A1 got married to Complaint Aug 2011. A1 to A4 was living with Complaint, around two moths A1 received treat call from unknown person, then filed a complaint against unknown person on Oct 2011, then Complaint (A1’s wife) filed false complaint against A1 & others and A1 wife had sported to the Unknown (later Convicted and paid fine Rs5000), who was filed of the A1’s wife. Then the Police had lodged compliant and A1 was arrested, A1 got bail under condition (3 days in week alternative days at police station)

A1’s wife filed DVC with false allegation against all (No Domestic relation R5 to R7) on Jan 2012. The DVC Hon’ble Court Deleted R5 to R7 based on complaint at fist hearing. Finally that DVC case was also withdrawn U/s 257 of Cr.P.C.

A1’s wife filed Divers petition on Nov 2012 without known to A1, the Family court grant Divers within 3 hearings as expertly. The same divers order filed in DVC case and withdrawn.  

In continuation that the Investigation officer declared in the charge sheet, A5 address was A1 to A4 address, but A1 & Complaint got marriage after A5 and his family had separately  lead.

I requested all, Gide me for filing of quash in high court below regiens

  1. After 4 years 3 months
  2. Did not leving with A1 & Complaint
  3. DVC court remove R7 ie.in 498a (A5) on 2012
  4. And other 

the Police has not served Notice till date for hearing

You can try for quashing, but the courts leave the matter for trail these days.
