@Ashish: Thanks for the update. I am presently working on the matter pertaining to jurisdiction only.

Hon'ble Court is on the decision of the above cited Delhi HC precedent dated 24.11.2010 which is against our client.

i will be thankful to you if you could provide me with certain more details regarding the case you mentioned as i am unable to get any details regarding the present status or facts of the case.

Sec138 NI Act seems to be working beautifully - to both complainant and defendant. Lawyers too stand to gain.

Maybe due to the vast no. of cases - special courts exclusively meant for the purpose, specially trained and oriented can be considered for this purpose.

One suggestion would be to dispense with the presence of both parties after the initial hearings - as many times parties are required to appear just to get adjourned dates from the courts. This causes hardships affecting their jobs, etc.
