Recovery suit

Hi, Can we claim a recovery suit based on the agreement on a stamp paper between the lender and the borrower as agreed on the conditions.

Q1. Do we have to pay a court fees to file a recovery suit or can we file a recovery suit without paying the fees, since I have an agreement with borrower.

Q2. If we have to pay the court fees, can you please share the details of the slabs of the court fees based on the recovery amount. Since my recovery amount is more than 50 Lakhs I need to know what are the fee slabs.

Kindly Advice.

Thank You

You can file a money recovery suit on the basis of the loan agreement.

You are required to pay applicable court fee.

The court fee varies from one state to another across the country.

Which state do you belong.

You may enquire locally.

Thank you for your reply Sir, I am from Bangalore. Karnataka, is it possible to share the details of the court fee slabs and also would like to know, since borrower has given me a cheque and would like to know if the cheque bounces, then can I also file a cheque bounce case.

If in case of a cheque bounce case, will I have to still pay the fees for the recovery suit or is there any exception on the fees.

Kindly advice, awaiting your response.
