refund of money

I have a query. I had approached a reputed consulting firm in Bangalore for immigration to Australia. They told me about their consultation fee whereby they would guide me on the paperwork work, submit to the embassy and get the processing done on my behalf. They gave me unsigned contract papers so that I could go thru them and then both parties could sign once I attach all the relevant documents ( work experience letter etc.). I gave the a cheque of Rs. 55000/- as initial payment assuming that I would be going ahead with my immigration plans. However shortly some mjor personal problem arose due to which I had to drop my plan and none of us signed the contract. I have been sking them to retrurn the cheque which has already been credited to their account. They are not refunding the money though no papers were signed, no processing of any documents was done and no services related to immigration was given to me.

What should i do? pls advise

Serve a notice for refund of the amount as no fee has been earned by them nor any services have been rendered to you. In case of their failure to refund, institute a suit for recovery of the amount.

Dear Ravi,

Parveen has hit the bulls eye however I would like to add you may put on record that as on date neither you have availed any services and as such nothing is due and payable and hence you are entitled to refund of your hard earned money.

Dear Ravi,

Just our of curiosity I have got an idea that how these agencies get licence to operate and on what terms and condition and how they get regulated.  Do your research and God willing if anything comes out take that department/agency in loop as well.
