Issue regarding land registration papers

 

Hello,

 

I’m seeking your assistance with a property document issue. My Dad purchased a piece of land  in Pune, India, in 1988 and built the house on it. Earlier our Area was part of Gram panchyat and was part of Haveli and later after 10 years were merged into Pune municipality corporationT.he problem  is that when we looked at the documents after 35 years, we found that we only have a duplicate copy of the land registration without the last stamped page. It seems my parents forgot to collect the original documents from the Taluka Haveli back then . Many others in the area face the same issue. As those have not been digitised yet. We’ve paid all the required taxes.

Last year, an agent approached us and mentioned that he can retrieve the original paper from the Haveli office . They took some advance, but up till now, he keeps saying that he was unable to locate the papers from the 1988 lot. We also paid the money officially for searching the papers a year ago.

Finally,  in the last 6  weeks, my Dad personally visited the concerned officer in the Haveli. He again said, “Give us time, and we will search for the documents from the pile of files.”

Every week, my father is getting the same response that they  are searching but have not found the documents yet.

Could you please advise on how we can proceed?

Is there anything else we can do to get the duplicate  if the original is lost by the authorities?

Please suggest a way as we are quite tired and frustrated

These are all practical issues, you may have to solve it locally, you cannot find remedy through legal sources though people may advise you to approach higher authorities or some other ideas.

As it is an old one it is not easy to trace the records about 1988. And it requires more time to search records.  If you know the registration number of the document there is some hope to get it.  But only with the year, it is more difficult to search. It is practical.  So request the officer where the document was registered.

but what if documents are not found and misplaced.. what next can be done?

any alternate thing? If I want to sell the property and buyer want secure home loan bank always wants the land registration.

No.  You shall obtain a copy of the document from any source.

File a RTI. Effective, easy and cost effective way. You can file it online too.

Was the purchase made through a registered sale deed? What is Haveli? How is it connected with registration of sale deed?
