Regarding confinement under threat to terminate from job

How can we prove confinement or 342 IPC and 506 IPC with 34 IPC under threat to terminate the job if letter is not signed by, how can we relate job to life as per article 21 of constitution of India

While posting such queries employee should post basic information!

What is this establishment; Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working? Are you under probation period or your service is confirmed in writing?

 

Do standing orders (model/certified) apply to establishment and your designation?

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?

Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date? How was your performance?

Are you a member of employee’s/trade unions?

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

Sir, I am workman medical representative. I was called to Delhi office. I handed over punishment letter for the charges of FIR against me which was proved to be false and cancellation accepted by CJM. ALL WAS IN KNOWLEDGE OF MANAGEMENT. ON PUNISHMENT LETTER IT WAS WRITTEN I ACCEPT. I REFUSED TO SIGN AND THEY THREATEN ME TO TERMINATE THEY EVEN DID NOT ALLOWED ME TO TO GO TO TOILET OR TALK TO ADVOCATE UNDER THREAT I SIGNED LETTER WITH RE MARK I"I AM SIGNING THIS LETTER UNDER PRESSURE AND WITH OBJECT" TO WHICH THEY FORCED ME CUT AND MANHANDLED. I COULD INFORM MY FAMILY WITH GREAT DIFFICULTY AND POLICE PSR RESCUED ME. MLR WAS CUT AND FIR AGAINST ALL FOUR WERE REGISTERED. NOW WE ARE HAVING FINAL ARGUMENT AFTER FIFTEEN YEARS. I AM SOLE injured eye witness. Fir registered u/s 323,342,506,384 34 IPC but during charge framing 384 under influence was deleted though announced in open court. We objected but if no use. TO MAKE MY case too strong . I need support of such strong judgement. That threat to job is threat to life under article 21 of constitution.
