Rejection of plaint

My wife cheated by hiding her past history and married me. I filed divorce in April, 2017 and she in August, 2017 in different court. she took alimony in her previous divorce and she filed maintenance case. She filed transfer and stay for my divorce petition in high Court. High Court granted stay for 3 months which was expired. Now can I file rejection petition under order 7 rule 11 of CPC for her 1) divorce petition, as I 1st filed, for which trial is going, same cause of action 2) as she already taken alimony in her previous divorce. Shall I file petition under order 7 rule 11 of CPC to reject her petition
