sec : 211 : False charge of offence made with intent to injure.
Without having just or lawful grounds any person with an intention to cause injury to any person instituties or cuases to be institutied any criminal proceedings against that person or falsely charges any person with haivng committed an offence, such an offence shall be punished with imprisonment for a term which may extend to two years or with fine or with both.
If If criminal proceeding be instituted on a false charge of an offence punishable with death, imprisonment for life or inprisoment for 7 years or upwards, shall be punishable with imprisonment or either descripttion for a term which may extend to 7 years and shall be liable to fine.
This section includes two distinct offences:-
1. Actually institution or causing to be instituted false criminal proceedings aginst a person
2. Preferring a false charge against a person.
The necessary ingredients to consitutue either of the above offences are
1. The criminal proceedins must be instituted or the false charge made with intent to injure
2. the criminal proceedings must be instituted, or the false charge must be made, without just or lawful ground, in other words, it must be make maliciously.
