Seeking for promotion -reg.

Good morning sir/Madam,

I wanted to register my PWD certificate with our department when I joined duty in 2002 itself. But, as per the then admin officer, I was not able to register my PWD certificate since there were no vacancies for PWD candidates. So, got through my OBC category.

Later on, as per the guidelines from the Govt. of India, I tried to register my certificate in our department. But the Admin Officers refused and neglected my request. So, I got frustrated and approached the CAT to get justice. 

Meanwhile, our department asked me to submit my original PWD certificate verification during my Phase-I training in Chennai.

So, I thought that the case with CAT will not be required further and asked my advocate to withdraw my case from CAT  since our department had called for certificate verification.

Thereafter, on my promotion, I joined another office in the same department where our GM sir approved my request to add my disability certificate in the service book.

So, OA has been closed.

But, now our department staff asked our GM sir not give any promotion and approval as OA number from CAT is live.But the OA has been closed now.

Sir/madam, Whether I Will get the promotion or not please .

You can furnish the details and copies of the.case that was closed with a request to treat the case as closed.

The tribunal's orders also may be submitted and clarify your department

Yes.  You shall submit a copy of the tribunal order to the department that the case is closed.

You have stated to have withdrawn your OA in CAT, accordingly any order passed therein do not have any effect on the dispute / problem faced by you.

Your initial appointment was not in PWD but you have availed benefit of being in the OBC catagory, accordingly you can seek relief(s) under OBC catagory.

It is better to consult a local prudent lawyer practicing service matters for proper analyses of facts, professional advise and necessary proceeding.
