Service tax

SIR,

I HAVE PURCHASED A READY TO MOVE FLAT IN HYDERABAD WHERE IN THE LAND OWNER AND BUILDER HAS COLLECTED @ 4% SERVICE TAX EXTRA ON THE AGREED VALUE.  NOW WHEN ASKED FOR CHALLAN COPY OF SERVICE TAX PAID BY HIM TO THE DEPARTMENT HE SAYS THAT IS HIS PERSONAL HE CANT SHARE THE SAME WITH ME.

MY QUESTION IS WHETHER BUILDER OR LANDOWNER CAN CHARGE THE SERVICE TAX FROM THE PROSPECTIVE BUYERS ON READY TO MOVE PROPERTY AND CAN THEY DENDY IN GIVING THE CHALLAN TO THE BUYER.  WITH DISCUSSION WITH HIM I DOUBT THAT HE HAS NOT PAID THE AMOUNT TO GOVERNMENT TREASSURY.

KINDLY GIVE YOUR SUGGESTON.

Whatever may be important is agreement. In agreement you already agree to pay the 4% tax and you can not violate the terms and conditions.

Mr. Advocate,

whether there is 4 % service tax on the cost of flats charged by the builder. To my knowledge it is 15% of 25% of cost of flat. It may work out to 3.75%.
