Stamp duty

Dear Experts,

For filing a declaration of suit to seek null and void of illegal revocation of gift deed can a court accept initial court stamp fee at the time of  filing the suit (say 10% of the total court stamp fee) and pay the balance court stamp fee after disposing off the case.  If yes, do I have to make petition or representation to the court before filing the declaration of suit?
