Submission of annual reports of state govt owned companies before state assembly

Sir

The concerned company is a 100% state Govt company of west bengal.

In every year it has to submit 450 copies of annual report  to be laid before W B State Assembly.

My query before senior fellow experts is: why 450 copies required to be submit?

Is their any rules under Companies Act 1956/2013 or The Constitution of India or W B assembly rules?

I cammot find anything like that.

Please enlighten me.

Regards

Abhijit

The answer to this question can be found within the department itself.

You find out the list of persons or department heads and subordinates to whom the copies are to be served and since when this practice is going on and also whether this practice can be discontinued.

These issues may not be involve law or perhaps it is only a practical procedure that is being followed

Yes, the issue appears to be matter of procedure than law.

Hi Abhijit,

Your question regarding the requirement of submitting 450 copies of the Annual Report by a 100% West Bengal Government-owned company to the State Legislative Assembly is insightful and merits a structured explanation.

As per Section 394 of the Companies Act, 2013 (which corresponds to Section 619A of the Companies Act, 1956), every State Government company is obligated to place its audited accounts and annual reports before the State Legislature. However, the Act does not prescribe the exact number of copies to be submitted.

The requirement for submitting 450 copies is likely derived from internal rules or administrative instructions of the West Bengal Legislative Assembly, not directly from the Companies Act or the Constitution. State legislatures typically have specific procedural rules for placing documents before the House and circulating them to MLAs, library, committees, secretariat, and archives.

This practice is an administrative necessity to ensure each Member of the Legislative Assembly (MLA), relevant departments, and legislative staff receive copies for scrutiny and record-keeping. You may refer to the Rules of Procedure and Conduct of Business in the West Bengal Legislative Assembly or consult the Assembly Secretariat for the precise rule or circular under which this number has been prescribed.

You can get in touch with me at adv.vishesh@icloud.com to discuss this further.
