We are three brothers, and both of our parents have expired. There are two flats in Mumbai, belonging to our parents (purchased by our parents), and both flats are under owner ship of my mother (last expired).
The nomination of the flats has been done before the death.
Unfortunately there is no deed done by any one of the parents, therefore I think we need to obtain succession certificate from the court.
Please advise on procedure, and what documents would be required for aplication of succession certificate.
Both flats are in registered coperative societies. How much stamp duty is required to be paid to the court for obtaining the succession certificate ? Does the below article apply to our case ?
Also if we declare, in application of succession certificate to the court, that there are 3 brothers as successors of the properties, can one of them sell and distribute the money equally between the 3 brothers. Is there any procedure for doing this kind of transaction. If so please give steps.
Also can any one successor give the property on rent (with / without succession certificate).
