Filed RCOP eviction case under tamil nadu rent control act in 2011 December for own use. I have purchased this flat in 2007 Feb(i.e. as per sale deed).
Now the case is on Tenant evidence stage.
Tenant lawyer is saying at the time of application, building age is less than five years (i.e. 4Years and 10 months only) hence application should be dismissed. (As per Tent Act Section 30(i))
As per current date building age is 6 Years whether my application will be allowed or they will consider only filling time and dismiss the case.
Could you please clarify?
