Tenant not paying rent and cheque bounce

Hello Sir,

I had rented my flat to a tenant and the tenant paid the rent on time only for the first month, now it is almost 2 years and the payments are irregular and he has not paid the rent for the last 6 month amount to more than 1 lakh rupees The deposit amount was also adjusted stating that he will vacate the flat. I had to disconnect the electricity due to this. after the disconnection of electricity he handed over 2 cheques with the pending amount and both the cheques are bounced due to insufficient funds and the tenant is not ready to vacate the flat. SInce I am an NRI, I am unable to chase him regularly. I have now decided to disconnect electricity and water supply to the flat untill he pays the pending amount and vacates the flat though the caretaker

Kindy advise if I can proceed to take legal action against him

You issue a legal notice demanding the cheque amount failing which you can file a cheque bounce case.

You can issue a legal eviction notice to evict him followed by an eviction suit for default in rental payment.

You can decide about disconnecting the essential services but he may approach court seeking restoration.

I fully agree with the expert advise of Mr. T Kalaiselvan.

Disconnection of electricity and / or water shall invite criminal offence against you, avoid such a coercive action against the tenant otherwise you will land  in a thick soup.

Issue legal notice to determine tenance and payment of arrears of rent within 15 days followed by an eviction petition through jurisdictional civil / rent court seeking professional services of a local prudent lawyer.
