Dear sir,
land lease period of house 1967-1987 (patta is registered in Mutation) tenants had not evicted since now.
owner is Mr A and he deceased in 2010, No proof is availaible whether he was receiving rent or not,
and in some casein year 2000 of the same property he has informed court that tenant was his oral tenant.
This property is ancestral property
My query is :-
whether his successor can enforce their right of rent from 2010 to till now and what are the effects of limitation act on right to ask payment as per my knowledge there is time limit prescribed is 12 years to suit a file for eviction of tenant from theperiod tenancy is determined but no restiction to claim rent.
