Hi,
I have given my house on Rent in 2013 on 11 months lease for 6500 INR per month, however after 11 months tenant didnt vacate the house and stopped paying the rent for last 7 months
we have sent him notice through the lawyer 7 months back and we tried to negotiate with them but they didnt respond and asked us do whatever you can do to get this house vacated. on top of that they filed a complaint against us that we are trying to force them to vacate the house.
After having no option we consulted the lawyer again and he advised us to file a suit (Transfer of property Act - 106) Against them. However i am not sure if tenant will pay us monthly rent during the course of case or we will get our lump sump amount once case if settled or decided by court.
please suggest me whats the best way to get my house vacated and get the monthly rent until final verdict is given.
