Dear Experts,
This is with regard to the illegal revocation of Gift Deed which I have posted on this forum, some time back. I thank you all the Forum experts who have given valuable advise on this subject matter.
As per the advise of the experts, as a first step, I have moved a Caveat Petition in the local District Munsiff Court and served the copy of the Caveat to the opposite parties by Regd. Ack due. However, the opposite parties refused to collect the same and returned as "Refused". Followed by this, I have also moved Plaint and Interim Application in the same court for declaration of suit for null and void and interim injunction.. Awaiting the Interim Award by next week.
In the mean time, the opposite party has constructed a small wall in my property to get EB connection with his available documents. On hearing, I visited the EB and protested and explained the background of the property and handed over the copy of the Caveat and gave a written complaint and requested not to give EB connection as this matter is now in the court. Now, the EB officials stopped giving connection. The erected wall and the sand, stones are lying still on my property . I have not disturbed.
Further to this development, the opposite party is visiting my property quite often. Just looking and going back. This information was relayed by my security who is guarding my property.
Now my questions are:
1) What are all the options available for me to take criminal action against the erring party for tress-pass especially when I have moved a Caveat and this matter is in the court.?
2) Can I take criminal action now for tress-passing or do I have to wait until I get the interim order?
3) When the Caveat is moved and the subject matter is in the court, can the erring party enter my property whenever the security guard is absent (for going Lunch, etc.)
I shall be thankful for getting valuable advise on the above.
