Uncle not allowing to build construction

My grandfather own 6000 square feet land in hometown.he has expired in 2003.i have 2 uncle and 2 aunt...uncle is not allowing to build construction in our share.how can we build construction in our share?

Is there any will by your grandfather?  Did he die intestate?  How many legal heirs are there? Your query requires clarity.

- No my father don't have will.

-Yes he died without will

- There are 5 legal heirs including my father

 

My question is can I apply for partition deed?

Your father has the option to file a suit for partition.

 Your father has to contact a local advocate and issue notices to all co-sharers seeking partition in metes and bounds.

Hello,

Your father has an equal share along with 2 uncles and 2 aunts. They cannot restrict you to construct house in your share. You can approach the civil court and file a partition suit for identifying your share in the property. So that you can construct a house without any hurdles from your uncles and aunts.

File a suit for partiition of the subject property and go ahead with construction in your share.
