Unlawful termination from icici bank

Case Summary: Unlawful Termination from ICICI Bank

Background: Employment Details: Employed at ICICI Bank since 2019 as Deputy Manager 1, Bhubaneswar Phone Banking Group.

Medical Leave: Hospitalized in October 2023 due to severe dengue. Took medical leave approved until November 28, 2023. Due to health deterioration and a family emergency, could not return on November 29 and informed reporting manager. All medical documents were submitted.

Termination Issue:

Unlawful Termination: Notified of termination by the Staff Loan team without prior notice or official communication. No termination or absenteeism letters were received. No formal termination email or letter was provided.

Responses and False Claims:

Lack of Response: Multiple attempts to contact management and HR were ignored. Bank falsely claimed termination after two reminder emails, which were never received.

False Reasons: Termination reason cited as “unauthorized absence” despite medical leave and communication.

Escalation:

Chief Labour Commissioner (CLC): Joint discussion held on June 28, 2024. Bank submitted a baseless report on August 12, 2024. My response on September 8, 2024, remains unaddressed.

Regional Labour Commissioner (RLC): Received a conciliation meeting request. Communications with HR and RLC were inadequate.

Financial Impact:

Loan: Ongoing loan of 3.76 lakhs taken for a PO program. Job loss has caused significant financial strain. Sole breadwinner supporting family.

Request for Legal Assistance:Seeking legal assistance to challenge unlawful termination, ensure a fair review, and secure reinstatement or compensation.

Since the reconciliation effort made by the labor commissioner had failed you have no other option than to approach the labor court for a direction to the bank authorities to set aside the termination order and to reinstate you with full benefits.

Could you please suggest How can I approach to Labour Court? And How long approximately will it take to serve justice? And How will it cost? Asking because since 1 year I'm jobless hence facing extreme financial issues.

File your petition before concerned / jurisdictional Labour Commissioner through a local prudent lawyer or Union assailing termination order.

As you have exhausted the remedies before labor commissioner, you now have to approach labour court only for remedy and relief.

You may consult a local lawyer practicing in labour court collect all the details including court fee, lawyer fee etc.
