Want to meet my son

Hi Experts,

Wife filed divorce U/s 13 1 ia. We have 8 moths old son. As i no getting custody as of now is not possible, hence want to file for visitation rights. My Queries are

1. Can i file interim weekend visitation rights

2. My advocate is saying that i should file interim visitation U/s 26 of HMA. Is this correct or should i file under G & W act. 

3. What is the diffrence between HMA 26 & G&W act

4. What points should i raised so that i can get maximum visitation rights

5. My parents also want to meet my son, So can i add their name in th application

You need to file for Child Custody under Guardians and Wards Act and Pray for Interim Child Visitation.

The court may grant  supervised access since the child is too small.

You need to remain in contact with the child so that the child recognizes you as a parent.

you can later ask for more access by filing modification of access application.

Its a long long battle for you as the age of child is too young.

There are many fathers who have fought long child custody battles and are now getting meaningful access to the child. The relationship with the child is also well established.
