Dear Legal Experts

Whether a society registered under West Bengal Registration of Societies Act can be construed as operating under commercial laws?

IF A SOCIETY DOES A COMMERCIAL TRANSECTION , IT WILL BE TREATED AS AN ARTIFICIAL PERSON AND ALL THE COMMERCIAL LAWS WILL BE APPLICABLE UNLESS SPECIFICALLY EXEMPTED IN ANY PARTCULAR LAW.

Does entering into an agreement as per Contracts Act is a commercial activity? and a society (which is a "not for profit" organisation) can operate under commerical laws.

Any society duly registered under the respective societies act is a legal entity and all laws applicable to contracts become applicable to it.

Yes, commercial laws will apply. It is a legal entity. It can enter contracts or own property. If it enter any contract, contract act will apply, for its banking transactions, negotiable instrument act will apply, for sale of goods or products or services, consumer laws will apply. Even shops and establishment act will apply.
