The burden to prove the Will is always on the person getting benefiti.e., beneficiary or executor of the Will, either contested or uncontested and unless & until the Probate Court satisfy himself/herself regarding the genuineness of the Will the probate cannot be granted. Regarding time limit no body can give accurate period of time but ofcourse if uncontested, the Will may be probated within six months after filing and applying for Probate that too in favourable circumstances.
