Will probate case

My lawyer filed a will probate case in April 2012. For his personal benefits, he paid court fees for 1lakh valuation for the property located at Orissa at 2.5% and pocketed rest of the money. When the court pescar was approached, we were told to pay the actual valuation at the rate of 5% and surcharge at the rate of 2.5% for showing undervaluation. How do we know the actual value of property when we are not the permanent residents of the state? Has the lawyer shown professional negligence towards the work assigned to him by not showing the exact value of the property at the begining and therefore invited surcharge? Is the court fees same all over India or is it different state wise?
