Working wife - maintenance

Hello Everyone,

Wife filed false 498A case against Husband in in-laws and case went for mediation. Husband is working, salary apprx 50 thousand. Wife also working salary apprx 40 thousand. In the mediation, wife demands 45 lakhs as permanent alimony. The settlement did not happen.

There is no way that she can win the case as the FIR is false and there are no evidence.

All the property are in Husband's father name and husband has only property worth 10 lakhs.

Now, if husband demands divorce, will court consider Husband's father property also. She is working women but salary is less 10 thousand than husband so would court pass order to pay an alimony or maintenance. If so, what will be the maximum amount.

Sir,

If wife also employed and earning a decent salary means ,husband no need to pay any maintenance or alimony.  You must  prove that wife is working and earning forty thousand salary.

As u said that your wife is employed and earning 40 thousand  in a month so there is no need to pay maintenance but you have to prove that she is employed and earning such amount of money..

What if she used to make decent salary and quit job after marriage  and not making anything at the time of divorce ?
