Workman defective inquiry

Why workman was given first opportunity for evidence in ex parte defective inquiry instead of mangement. Management is appealing against this order

First, if the enquiry is proceeding ex-parte, then where is the question of workman's evidence? An ex-parte enquiry takes place only when the workman is not participating in the enquiry.

First of all I feel sorry if I may not be able to frame question properly Let me try again

Labour Court has set aside defective exparte domestic inquiry and adjourned the case for workman evidence.

Generaly management is given opportunity for fresh evidence when inquiry is proved defective and is set aside.

Now my question is why labour court gave first  chance to workman.
