Allahabad HC Sets Aside High Llevel Committee Over Ppolice Recruitment Scam 1/15/2009 A division bench of the Allahabad High Court set aside the high level committee on whose recommendation several senior IPS officials were suspended and over 20,000 police constables were terminated from the service. The division bench comprising Justices A N Verma and S N Shukla passed the judgement on a petition filed by suspended IPS officer Brij Bhushan Baskhi and others. The bench has also set aside the committee headed by senior IPS officer Shailja Kant Mishra on whose recommendation 25 IPS officials were suspended and over 20,000 police constables were terminated. In its ruling the Judges maintained that the committee was set up on the complaint of three legislators of the ruling party to conduct enquiry in respect of the recruitment in the police department. ‘It is only both pre-determined, intentional and with oblique motive to tarnish the image and lower the morale of police force that the committee was constituted,’ the bench observed. The judgement said one of the MLA Irshad Hussain, who was also the legislator in the previous government, did not raise the issue either in the Assembly or by other means at any forum. The judgement has given respite to the IPS officials, who had been suspended for not following the norms in the appointment of over 20,000 police constables during the Mulayam Singh Yadav regime in 2005-06. A similar case was also pending at the Supreme Court where the dismissed constables had challenged their termination on the recommendation of the committee report. UNI
