Certificate Course on Arbitration - (26-09-2008) --------------------------------------------------------------------- ----------- Arbitration as an emerging area of practice Globally justice dispensation system is reeling under tremendous pressure, due to huge backlog of cases, shortage of judges, lack of adequate infrastructure in the courts, time consuming legal procedures and complexities of modern commercial transactions. Under the circumstances, arbitration has emerged as the most effective dispute resolution mechanism for speedy disposal of commercial disputes, both domestic and international. Arbitration, as an area of practice offers immense professional opportunities for members of the Institute given their expertise in commercial and financial matters. Members of the Institute being providers of business advisory services, are in an advantageous position of appreciating the commercial background of a dispute and thereby provide significant level of services as Arbitrators. Council Initiatives: In the above context, the Council has initiated the following steps: Constitute a panel of eligible members who are desirous of taking up arbitration as an areas of practice. The names and contacts details of the arbitrator empanelled will be hosted on the website of the Institute. Parties to a dispute who are on the look out for an arbitrator for resolving their disputes may choose any of the members empanelled and deal with them. Provide a framework of ICAI Arbitration Rules for conduct of arbitration by members Frame ICAI Code of Ethics for Arbitrators to ensure fair and transparent arbitral proceedings and ensure accountability Build capacity among the members Certificate Course on Arbitration As part of the Capacity Building measures in the field, The Council has decided to launch a Certificate Course on Arbitration for members for equipping them with the necessary legal expertise in the field so that they can forge ahead in this area of practice. The objective of this Course is to familiarize the members with the relevant laws which impact the arbitration process and the practical procedural aspects and to build the competency level of the members of the Institute to position them as multidisciplinary consultants in the global service market. The course is targeted at members who are desirous of acquiring knowledge in the field so that they can extend their area of practice in the subject. Business entities, in the private and public sector would be the potential beneficiaries of the process. Apart from the comprehensive theoretical aspects, this course, first of its kind in India, will sharpen the expertise and excellence of our members through multiple case studies and mock arbitration proceedings. The Course will be launched at New Delhi, Mumbai, Kolkata, Chennai, Kanpur and other mega cities. The registration for New Delhi will start on 1st October 2008.
