Bombay HC: Contempt of Court Case Filed Against Police Inspector Dated : 28-02-2009 Sourece : UNI Delhi : MUMBAI: Social activist Aires Rodrigues has filed a contempt of court petition before the Goa bench of Bombay High Court against a police inspector for not filing chargesheet against state health minister Vishwajit Rane and closing the criminal complaint instead. Mr Rodrigues, in his petition, stated that on September 23, 2008, on instructions of police inspector Gurudas Gawade, who was present in the court, a statement was made by public prosecutor Winnie Coutinho that investigation into the criminal complaint against the minister was pending and a chargesheet would be filed by the Old Goa Police. Mr Gawade committed deliberate contempt of court by disobeying and failing to abide by the statement made and recorded by the High Court. He closed the case on December 30, 2008 without filing the chargesheet, Mr Rodrigues stated. ‘The inspector did so malafidely to please Mr Rane and hence the act of contempt was gross, contumacious and interferes with the due course of administration of justice,’ Mr Rodrigues said. He also said the Old Goa police initially failed to register the FIR against Mr Rane but did so following serving of a legal notice 22 days later. The conduct of the police officer would also come under the scanner of the Supreme Court, which is hearing a Special Leave Petition (SLP) filed by Mr Rodrigues against the minister challenging September 23,2008 order of Justice N A Britto of Bombay High Court at Goa. The high court rejected the prayer to allow issue of summons to Divya Rane, wife of the health minister, in a case of threatening to kill Mr Rodrigues. UNI
