Kerala HC: Illegitimate kids have right to parental property

Observing that illegitimate children should also get succession rights in the property of their parents, the Kerala High Court directed the Union Government to make a law in tune with this judgement. A Division Bench comprising Justices Haroun-al-Rasheed and C N Ramachandran Nair also directed the Centre that a law should be made in this regard which was applicable to all religions. The court noted that international conventions demanded that illegitimate children should be given a right in the property of their parents. Section 125 CrPC also provided for such a right to illegitimate children. The Supreme Court had also upheld this in earlier judgements, the court said. It also directed that a copy of the judgement be handed over to the National Law Commission and the Centre. The court gave these directions while rejecting an appeal filed by Ms Gina Antony against the award of Motor Accidents Claims Tribunal, Pala, granting compensation to the illegitimate children of her husband.
