Don't rush to court over matters related to governance: SC

New Delhi, Apr 1 (PTI) Citizens unhappy with the performance of an elected government should vote it out of power rather than rushing to a court which "is not a remedy for all evils," the Supreme Court said today. "This is democracy where elections are held. You vote for a better government if you are not satisfied with the governance," a bench of Justices H K Sema and Markandeya Katju, observed while dealing with a PIL seeking adequate road safety measures in the country. The apex court sought to dispel the "illusion" that courts are the panacea for overcoming all the evils plaguing the country. "There is a wrong illusion. Many evils cannot be cured by courts. Court is not a remedy for all evils. People will laugh at us," the bench observed. Maintaining that judges should know their limits, the bench said the court cannot legislate and take over the functions of the legislature. "Courts can only make recommendations but cannot make any binding law," Justice Katju speaking for the bench observed. The apex court observed after counsel Prashant Bhushan appearing for an NGO Common Cause sought directions from the court to the Union and States for putting in order fool-proof traffic safety measures across the country to prevent the growing number of motor vehicle accidents in the country. It was submitted that thousands of people in the country are every year either losing their lives or getting injured in accidents. PTI
