HC rejects PIL for cancellation of DDA's draw

The Delhi High Court on Wednesday (January 28) rejected an Indian Air Force (IAF) employee's plea seeking cancellation of DDA's recent draw for flats, observing that the city police has initiated a probe into the alleged irregularities committed by officials. "The probe is on and at this stage you have approached the court. You have been granted liberty to file the petition after the investigation is over," said a Division Bench of Chief Justice A P Shah and Justice Sanjeev Khanna and dismissed a PIL filed by Rajesh Kumar, a defence personnel seeking cancellation of the draw. In the PIL, the petitioner said, "The draw of lots made by DDA is illegal, arbitrary and grossly against the public policy and there are sufficient proofs to show that the draw suffers from malpractices coupled with irregular and irresponsible conduct of DDA." Kumar who is presently working in Indian Air Force, alleged that many applications were filed using fake names and the DDA authorities failed to verify them. This resulted in the allotment of flats against these applications, he added. Referring to various media reports, Kumar said that three persons, with same mobile number, were allotted flats and people belonging to a particular caste from Rajasthan were allotted most of the seats under the category of Scheduled Tribe. Acting on a complaint filed by one such unsuccessful applicant, the Economic Offences Wing of Delhi Police's Crime Branch has already started looking into the alleged irregularities in the draw. So far six persons, including Laxmi Narayan Meena (54) who is a former SBI employee and a resident of Rajasthan's Jhunjhunu, have been arrested.
