The Jammu and Kashmir High Court has dismissed a petition seeking directions to the Election Commission (EC) to quash the 2008 General Assembly elections in the state.



The petition was filed by the Awami National Conference (ANC) Vice President Muzaffar Ahmad Shah, cousin of Chief Minister Omar Abdullah, seeking nullification of the whole elections.



The single bench of justice Nisar Ahmad Kakru in his order said the law is settled that a person aggrieved of the election has a right to challenge the same.

He said the petitioner, if aggrieved, can also seek justice and nothing prevents him to opt for that remedy.



However, the Court said seeking nullification of the whole elections, that too without citing any cause, is not according to law.



About the complaints, the Court said the proper course for the petitioner was to approach the forum established under the statutes for determination of the complaints and dismissed the case
