Mannatech, Inc., a manufacturer of nutritional supplements, said Friday that the US District Court Judge found Glycoproducts International Inc. guilty of infringing both Mannatech patents at issue in the case. The Jury stated that Mannatech is entitled to judgment as a matter of law that Glycoproducts infringed and induced other to infringe Mannatech patent. The ruling is in addition to the jury's earlier finding of willful infringement by Glycobiotics of Mannatech's '431 patent. Mannatech said that the Court also entered into a permanent injunction against Glycobiotics and related parties enjoining them from manufacturing and marketing within the US, or importing into the US, its product Glycomannan. The injunction also prohibits Glycobiotics from inducing others to infringe or assisting others in the infringement of these patents. Glycobiotics is also prohibited from falsely advertising the nature, characteristics or qualities of Mannatech's glyconutritional products. Keith Clark, senior vice president and general counsel, Mannatech stated, "We are now vigorously pursuing all damages that can be awarded by the court by virtue of these infringements on our patents. We did not compromise to this point and we intend to fully recover everything to which we are entitled." Shares of Mannatech are currently trading at $5.59, down 8 cents or 1.
