Patna HC Holds State Election Commissioner's Appointment Illegal 1/16/2009 Patna High Court held the appointment of State Election Commissioner(SEC) JK Dutta illegal and restrained him from performing the duties of SEC. A division bench comprising acting Chief Justice Chandramauli Kumar Prasad and Justice Ravi Ranjan passed the order. Earlier in September 2008, the court had asked the State Election Commission and the Commissioner to file their respective written response within 30 days on a petition seeking removal of the SEC from his post. Hearing the petition, a division bench of the court, comprising the then Chief Justice RM Lodha and Justice Kishore Kumar Mandal, asked all the three parties to submit their reply before the court on the petition seeking removal of the State Election Commissioner from his post.
