A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam declined to entertain a petition filed by Rashtriya Krantikari Samajwadi Party seeking directions to Praja Rajyam not to use the election symbol of railway engine which has already been allotted to the petitioner.
According to the petitioner, his party has been contesting elections with the symbol of railway engine since 2007 and therefore the same election symbol should not have been allotted to Praja Rajyam as it will create confusion in the mind of the electorate.
The apex court, however, granted liberty to the petitioner to approach the Election Commission for redressal of his grievance, if any in relation to the allotment of election symbol.
It was argued on behalf of Praja Rajyam that no candidate of the petitioner party has won elections on the symbol and therefore it continued to be a free symbol.
