The Supreme Court will hear a writ petition filed by former Tamil Nadu Law Minister and AIADMK leader D Jayakumar seeking declaration from the apex court that the constitutional machinery in the state has broken down and this is a case for imposition of Presidential rule in the state in view of what happened in Madras High Court on February 19, 2009. A bench comprising Chief Justice K G Balakrishnan and Justices P Sathasivam and J M Panchal fixed the hearing of the petition when it was mentioned today before it for urgent hearing. The petitioner has also demanded a judicial enquiry by a sitting or retired Supreme Court judge into the incident leading to the violent clash between the police and the lawyers in the High Court premises. The petitioner has also prayed to the apex court to direct the Union Government to seek a report from the appropriate authority and send it to the President of India for appropriate action. The respondents in the case are Union Government, State of Tamil Nadu, Registrar General, Madras High Court, DGP Tamil Nadu and Commissioner of Police, Egmore, Chennai. It has been alleged in the petition that the police force entered the High Court premises and attacked lawyers, court staff and indulged in vandalism and virtually went on a rampage. Even the litigants and the common public were not spared and the cars of lawyers damaged by the police, it added. An MLA and advocate, the petitioner has also alleged that if the Governor of the state des not act as per the constitutional scheme then the President of India is not rendered powerless. All courts in Tamil Nadu are closed till today vide the orders of the High Court. The Supreme Court is also going to hear tomorrow another petition filed by an advocate demanding immediate resumption of work in all courts in the state and in Puducherry.
